Terms of Service

These Terms of Service ("Terms") govern your use of the Mustmark website, application, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the European Union, or the minimum age set by your country) to use the Service. By using the Service, you represent that you are of legal age to form a binding contract.

2. Your Account

You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions and Billing

Mustmark offers free and paid subscription plans. By subscribing to a paid plan, you authorize us (or our payment processor, Creem) to charge your payment method on a recurring basis according to your selected billing cycle (monthly or yearly).

• Automatic renewal: Paid subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Price changes: We may adjust subscription prices from time to time. We will notify you of any price change at least 30 days before it takes effect, and the new price will apply to subsequent billing periods.
• Payment failures: If a payment fails, your subscription may be suspended and access to paid features revoked until payment is resolved.

4. Cancellation

You may cancel your subscription at any time from your account settings or by contacting support. After cancellation, you will retain access to your paid plan until the end of the current billing period, after which your account will revert to the Free plan.

5. Refunds

Subscription fees are generally non-refundable, except where required by applicable law or where we determine a refund is warranted in our discretion. If you believe you are entitled to a refund, contact support@mustmark.com within 14 days of the charge. Please note that our payment processor, Creem, may issue refunds within 60 days of purchase at its discretion to protect against chargebacks.

6. Acceptable Use Policy

You agree not to use the Service to:

• Upload or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;
• Upload or transmit content that infringes the intellectual property or privacy rights of any third party;
• Attempt to reverse engineer, decompile, or disassemble the Service, or otherwise attempt to derive the source code;
• Interfere with or disrupt the operation of the Service or its servers and networks;
• Use the Service to develop, train, or improve a competing product or service without our prior written consent;
• Use automated means to access or scrape the Service without our prior written consent.

We may suspend or terminate accounts that violate this policy.

7. Generated Content

The Service uses automated evaluation models provided by third parties to evaluate, summarize, and generate content based on your submissions. Generated output is provided "as is" and may be inaccurate, incomplete, or biased. You are responsible for verifying any generated content before relying on it. We do not guarantee the accuracy, completeness, or usefulness of any generated output.

8. Intellectual Property

You retain ownership of the content you submit to the Service. By submitting content, you grant Mustmark a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit that content solely for the purpose of providing the Service to you.

The Service, including its software, design, trademarks, and logos, is owned by Mustmark and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Mustmark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Mustmark is established, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
